Your use of Mortgage Street Financial Services Pty Ltd’s (MSt) website is governed by these Conditions of Use.

These Conditions of Use explain how your personal information will be treated as you access and interact with the MSt website.

Your use of the MSt website indicates your acceptance of these Conditions of Use, including any changes made to them.

Security codes

MSt may provide you with an access code to enable access to the website.  You acknowledge that the access code remains the property of MSt and that it will be kept confidential by you. MSt may, at its absolute discretion, permanently or temporarily deactivate your access code at any time.

Collection and use of information

MSt may collect personal information from you directly or via your use of our services. MSt will only collect personal information which is reasonably necessary for, or directly related to, our functions or activities.

Disclaimers

To the extent permitted by law, MSt and our related companies accept no liability for any loss or damage (including indirect, special or consequential loss or damage to any person):

  • arising from the use of or reliance upon information contained in or accessed through the MSt website.
  • should the MSt website be unavailable or not be available in its entirety, and
  • as a result of any virus, program bugs or similar causes

Trademarks and Copyright

MSt owns trademarks which are registered or under application. Some of those trademarks are used in the MSt website.

You are not permitted to use MSt’s trademarks without our consent, unless such use is otherwise expressly permitted by this website or by law.

The MSt website and its contents are copyright to MSt, or in some cases, to other parties. You are entitled to save and or print part or all of the MSt website for your own information but you are not entitled to alter it.

Changes to Conditions of Use

You agree that MSt may at any time vary these Conditions of Use by publishing the varied conditions of use on the MSt website.  The right of MSt to vary these Conditions of Use includes adding to and expanding them as the information and functions available through the MSt website change.

Sensitive information

Sensitive information is any information about a person’s racial or ethnic origin, political opinion, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record, or health.

MST will not ask you to disclose sensitive information, but if you elect to provide sensitive information, it will also be captured and stored.

Information from third parties

The MSt website also contains links to the websites of third party providers of goods and services (Third Party websites). If you have accessed Third Party websites through the MSt website, and if those third parties collect information about you, MSt may also collect or have access to that information as part of our arrangements with those third parties

Where you access a Third Party website from the MSt website, cookie information, information about your preferences, or other information you have provided about yourself may be shared between MST and the third party.

Advertising and tracking

When you view MSt advertisements on a Third Party website, the advertising company uses ‘cookies’ and in some cases ‘web beacons’ to collect information such as:

  • the server your computer is logged onto;
  • your browser type;
  • the date and time of your visit; and
  • the performance of their marketing efforts.

When you access the MSt website after viewing a MSt advertisement on a Third Party website, the advertising company collects information on how you utilise the MSt website (eg which pages you view) and whether you complete an online application.

Cookies

MSt uses ‘cookies’ to provide you with better and more customised service and with a more effective website.

A ‘cookie’ is a small text file placed on your computer by our web page server.  A cookie can later be retrieved by MSt webpage servers.  Cookies are frequently used on websites and you can choose if and how a cookie will be accepted by configuring your preferences and options in your internet browser.

MSt uses cookies for different purposes such as:

  • to allocate a unique number to your internet browsers;
  • to customise the MSt website for you;
  • for statistical purposes;
  • to identify if you have accessed a Third Party Website; and
  • for security purposes.

IP addresses

Your IP address is the identifier for your computer when you are using the internet.

It may be necessary for MSt to collect your IP address for your interaction with various parts of the MSt website.

Online applications

When you send a completed online application to MSt, we retain the information contained in that application.  MSt is able to then use that information to provide any financial services that you require.

You can also suspend and save online applications, so you can complete and send the applications at a later time.  If you suspend or save your application, the information that you have entered will be retained in our systems so that you may recover the information when you resume your application. Online applications that have been suspended or saved may be viewed by MSt.

Security of information

MSt takes reasonable steps to preserve the security of personal information in accordance with these Conditions of Use and the Privacy Policy If your browser is suitably configured, it will advise you whether the information you are sending us will be secure (encrypted) or not secure (unencrypted). If secure transmission is indicated, MSt currently uses 128 bit SSL encryption.

MSt takes all reasonable steps to protect the information in our systems from misuse, interference, loss, and any unauthorised access, modification or disclosure.

If MSt no longer requires your information, and is legally permitted to, MSt will take all reasonable steps to destroy or de-identify the information.
MSt regularly reviews developments in security and encryption technologies. Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Accordingly, although MSt strives to protect such information, MSt cannot ensure or warrant the security of any information you transmit to us or from our online products or services and you do so at your own risk. Once we receive your transmission, we take reasonable steps to preserve the security of the information in our own systems.

Direct marketing

MSt will not use or disclose sensitive information about you for direct marketing purposes unless you have consented to that kind of use or disclosure.

MSt may use your personal information for direct marketing purposes.  If you do not wish to receive direct marketing communications from MSt or from other organisations please message the broker relations team through Commhub or if the direct marketing is by email you can use the unsubscribe function. If you wish to know the source of the information being used, you may submit a request by messaging the broker relations team through Commhub.  MSt will respond to your request as soon as practicable.

Disclosure to overseas entities

MSt does not generally disclose personal information obtained from cookies to overseas entities in the course of our activities.
